Privacy Policy

This is an English translation of the Japanese プライバシーポリシー, provided for reference. The Japanese version is the original; if the two differ, the Japanese version prevails.
My Evergreen LLC (My Evergreen合同会社; “the Company”) sets out this Privacy Policy (“this Policy”) on how it handles user information, including customers’ personal information, in the smartphone application “Greenery”, the related website (https://greenery.club/) and the other services the Company operates (together, “the Service”). The Company complies with the Act on the Protection of Personal Information of Japan (the “APPI”) and other relevant laws, regulations and guidelines, and handles user information appropriately. By using the Service, you are deemed to have agreed to this Policy.
1. Definitions
“Personal information” means personal information as defined in Article 2, Paragraph 1 of the APPI, and includes information that can identify a specific individual, such as a name or date of birth, as well as information used in connection with a specific individual’s personal information, such as an email address, account information or a nickname.
“Usage Information” means the following information.
- Information about the content, history and status of your use of the Service, such as the parts of the Service you used, the dates, times and number of times you used them, and your behavior while using the Service
- Posts, photos, comments, records of plants and their care, and other information you publish or send on the Service
- Information about the device you use, and its identifiers
2. Information We Collect and How We Collect It
The Company may collect the personal information and Usage Information of customers who use the Service (together, “Collected Information”) as follows.
- Information you enter or provide: account information (email address, user name, etc.), profile information, Posted Content (photos of plants, care records, comments, etc.), the content of inquiries, and the like
- Information collected through linked external services: the email address, display name and the like provided by the external service when you sign in with a Google account or an Apple account
- Information collected automatically when you use the Service: device information (operating system, model, language setting, etc.), identifiers (the advertising identifier, an ID that identifies the app installation, etc.), log information (IP address, dates and times of use, operation history, etc.), and information collected through cookies and similar technologies (including web beacons and other similar technologies)
- Information about purchases of Paid Services: your purchase history and subscription status through the App Store or Google Play. Credit card numbers and other payment information are handled by the operator of each store, and the Company does not collect them.
On iOS, before using the advertising identifier (IDFA) to track your activity across other companies’ apps and websites (tracking), we ask for your permission through Apple’s App Tracking Transparency framework. Even if you do not give permission, you can use all features of the Service without restriction (in that case, the advertising identifier is not used for that purpose, and the ads you see are not based on your interests). You can change the permission at any time in iOS Settings under “Privacy & Security” → “Tracking”.
3. Purposes of Use of Collected Information
The Company uses Collected Information for the following purposes.
- To provide, maintain, protect and improve the Service (including sending reminder notifications for watering and other care)
- To verify identity and authenticate users
- To confirm purchases of Paid Services and manage billing status
- To respond to inquiries
- To contact you about matters concerning the Service and to send you guidance and announcements
- To research and analyze the use of the Service, to improve and enhance the Service, and to develop new services
- To customize the content of the Service for you
- To survey satisfaction with the Service
- To prevent and respond to fraudulent acts and acts that violate the Terms of Service
- To deliver and display ads of the Company or third parties and to measure their effectiveness (including attribution of app installs, account registrations, purchases and the like that come through ads)
- To aggregate statistically processed Collected Information in a form that cannot identify individuals and publish it as research results
- To resolve problems in the operation of the Service
Of the above, uses that involve tracking with the advertising identifier (IDFA) on iOS take place only if you have given the tracking permission described in section 2.
4. Proper Management of Collected Information
Those engaged in the Company’s work of managing and using Collected Information manage customers’ Collected Information strictly, pay sufficient attention to its handling so that no unauthorized access to, or loss, leakage or alteration of, personal information occurs, and carry out their work accordingly.
5. Provision of Collected Information to Third Parties
The Company does not provide personal data to third parties without your prior consent, except in the following cases.
- When required by laws and regulations
- When it is necessary to protect the life, body or property of a person and it is difficult to obtain the consent of the person concerned
- When it is especially necessary to improve public health or to promote the sound growth of children and it is difficult to obtain the consent of the person concerned
- When it is necessary to cooperate with a national agency, a local government or a party entrusted by either of them in carrying out affairs prescribed by laws and regulations, and obtaining the consent of the person concerned is likely to impede those affairs
Under the APPI, the following are not provision to third parties under the above: provision of personal data that accompanies the Company entrusting all or part of the handling of personal data to the extent necessary to achieve the purposes of use, and provision of personal data that accompanies the succession of business through a merger or other reasons.
6. Transmission of Information to External Services (Disclosure under the External Transmission Rules)
In providing the Service, the Company uses services (SDKs and the like) provided by the following external businesses, and in the process, user information is sent from your device to each business. For how each business handles information, please see its privacy policy.
Firebase (Google LLC)
Purpose: We use it as the foundation for providing the Service, including account authentication, the database, storage of images and other data, and delivery of push notifications.
Information sent: Account information (email address, user name, etc.), Posted Content, device information, identifiers
Google Analytics for Firebase (Google LLC)
Purpose: We use it to measure and analyze how the Service is used.
Information sent: App usage events, device information, identifiers, IP address
Firebase Crashlytics (Google LLC)
Purpose: We use it to analyze app defects (crashes) and improve quality. While you are signed in, we send your app user ID with the crash information, so that we can tell how many customers a defect affects and investigate defects you report to us (we do not send your email address, display name or user name). Crash information from after you sign out (including after deleting your account) is not linked to your app user ID.
Information sent: Crash information, device information, identifiers (an ID that identifies the app installation, and your app user ID while you are signed in)
Firebase Performance Monitoring (Google LLC)
Purpose: We use it to measure how long the app takes to start, display screens and communicate (to monitor and improve performance).
Information sent: Processing times, device information (model, OS version), carrier and network type, country, app version, Firebase installation identifier
Google AdMob (Google LLC)
Purpose: We use it to deliver and display ads and to measure their effectiveness.
Information sent: Advertising identifier, device information, IP address, information about ad views and interactions
Meta (Meta Platforms, Inc.)
Purpose: We use it to deliver the ads we run and to measure their effectiveness (attribution of app installs, account registrations, purchases and the like that come through ads).
Information sent: Advertising identifiers (the IDFA on iOS and the AAID on Android), app usage events (app launches, account registration, adding plants, subscription purchases, etc.), device information, IP address
Apple (Apple Inc.)
Purpose: We use it to measure the effectiveness of (attribute) app installs that come through Apple Search Ads. We use the information generated by iOS’s AdServices framework to query Apple’s attribution API.
Information sent: Attribution token, and information about the ad campaign that the token corresponds to
Amazon Associates Program (Amazon.co.jp)
Purpose: We use it to refer customers through the links to recommended supplies in the app and to measure referral fees.
Information sent: The usual access information your browser sends to Amazon when you open a link (IP address, browser information), our tracking ID, and a search keyword we have prepared in advance (a general supply name such as “観葉植物 液体肥料” (liquid fertilizer for houseplants), included in the URL as the link’s search condition). Which keyword is shown is determined mechanically from the condition of your plant (whether it has withered) and the plant’s identifier, but the candidates themselves are fixed wording set by us, and neither that identifier itself, your user ID, nor your plants’ names, photos, care records or other data on the Service is ever sent to Amazon.
RevenueCat (RevenueCat, Inc.)
Purpose: We use it to manage the purchase status of Paid Services (subscriptions).
Information sent: Purchase history and subscription status, app user ID, device information
The Service shows ads through Google AdMob. You can limit ad personalization (ads based on your interests) in your device’s operating system settings (on iOS, the privacy settings in Settings; on Android, the Google ads settings in Settings, and the like).
On iOS, the advertising identifier (IDFA) is sent to Meta and Google AdMob above only if you have given the tracking permission described in section 2. If you have not, no advertising identifier is sent to these businesses, and ad effectiveness is measured through aggregate mechanisms that do not identify individuals (such as SKAdNetwork).
7. Provision to Third Parties in Foreign Countries and Storage Abroad
The services provided by the external businesses in the preceding section are provided mainly by businesses located in the United States, and Collected Information may be stored on servers located in foreign countries (mainly the United States). When the Company handles personal data in a foreign country, it understands that country’s system for the protection of personal information and takes the necessary and appropriate measures for security management, in accordance with the APPI. For information about each country’s system for the protection of personal information, please see the website of the Personal Information Protection Commission of Japan and other sources.
8. Security Management Measures
The Company takes the following measures to prevent leakage, loss or damage of the personal data it handles and otherwise to manage its security.
- Establishing a basic policy (establishing and publishing this Policy)
- Establishing rules for the handling of personal data
- Human security management measures (training and supervision of those who handle personal data)
- Physical and technical security management measures (access control, authentication, encryption of communications, storage on servers in environments not accessible to general users, etc.)
- Understanding the external environment (understanding the systems of foreign countries when using services of businesses located in those countries)
9. Response to Leakage and Similar Incidents
If a leakage, loss or damage of personal data, or another situation concerning the security of personal data, occurs that poses a high risk of harm to the rights and interests of individuals, the Company promptly reports it to the Personal Information Protection Commission of Japan and notifies the persons concerned, in accordance with the APPI.
10. Managing and Correcting Registered Information, and Deleting Your Account
- You can check and correct part of your registered information at any time with the features in the App. If any of your personal information is inaccurate, please correct it in a timely manner.
- You can delete your account (close your account) at any time from “Settings” → “Delete account” in the App. If you cannot use the App, you can request deletion in the way described on the account deletion page.
- From the moment you request account deletion, you can no longer sign in to the account, and the plants, care records and comments on other customers’ posts that you had made public are no longer public (plants in a group you own can still be viewed by that group’s members until they are deleted). 60 days after your request, the Company deletes the authentication information used to sign in to the account (the link with your Google account or Apple account), your profile information (display name, user name, bio and profile image), your plants, care records and photos, your comments on other customers’ posts, your likes and stars, your follow relationships, your notifications, the groups you own (which other members can then no longer use either), and other Posted Content tied to the account (deletion runs once a day, so it is completed within a few days after the 60 days have passed). Deleted information cannot be restored.
- Deleting your account does not cancel a subscription purchased on the App Store or Google Play, and the store continues to bill you. Before deleting your account, please cancel the subscription from the subscription management screen of the store.
- The following information is kept after account deletion, to the extent described below.
- The purchase history of Paid Services (the records of purchases, renewals and refunds kept in RevenueCat): for the periods required by laws and regulations, to fulfill accounting, tax and other legal obligations and to respond to disputes. After account deletion, the Company does not use it in combination with other information it holds.
- Defect information and usage measurement information (the information sent to Firebase Crashlytics and Google Analytics for Firebase in section 6): until the retention period of each service has passed.
- Backups and system logs: until their normal operational retention periods have passed.
- Apart from the above, if you wish your retained personal data to be erased, please make a request through the procedure set out in “14. Procedures for Disclosure, Correction, Suspension of Use and Other Requests Concerning Personal Information” below.
11. Disclaimers and Notes
- For how customers’ information is handled in the services of external businesses linked from the Service, please see the privacy policies and other rules of those businesses. The Company is not responsible for the handling of information in the services of external businesses, except where there is a cause attributable to the Company.
- Posted Content that you post publicly on the Service (photos of plants, care records, comments, etc.) can be viewed by other users. Please use the Service with sufficient care about what is made public, such as information that appears in the background of photos.
- Please manage the information used to verify your identity strictly yourself, so that it is not lost, forgotten or known to any third party.
12. Information of Minors
If you are a minor, your parents, guardians or legal guardians (“Guardians”) must agree to the content of this Policy, the Terms of Service and related rules, and must give comprehensive consent to your use of the Service in accordance with this Policy, the Terms of Service and related rules.
13. Changes to This Policy
The Company may change this Policy in response to changes in laws and regulations, changes in its business or other circumstances. When the Company changes this Policy, it announces the change by displaying it in the App, posting it on the Company’s website or by other methods the Company specifies. However, when making a change that requires your consent under laws and regulations, the Company obtains your consent in the manner it specifies. Before accessing the Service or using the Company’s services, please be sure to check the latest version of this Policy.
14. Procedures for Disclosure, Correction, Suspension of Use and Other Requests Concerning Personal Information
In accordance with the APPI, you may request the Company to notify you of the purposes of use of your retained personal data; to disclose it (including disclosure of records of provision to third parties); to correct, add to or delete it; to suspend its use or erase it; and to stop providing it to third parties. Please make requests to the contact point below. After confirming that the request comes from you, the Company responds without delay in accordance with laws and regulations.
For requests for disclosure, the Company discloses by the method you designate among the methods it specifies, such as providing an electronic record (where disclosure by that method would cost a large amount or would otherwise be difficult, by delivering a document). If the Company charges a fee for a request for disclosure or the like, it tells you the amount in advance.
